These Terms govern your access to and use of the TourWhisper website, mobile experience, audio guides, digital content, accounts, purchases, location-based features, reviews, and related services operated by TourWhisper, LLC.
Welcome to TourWhisper. These Terms of Use govern your access to and use of the TourWhisper website, mobile experience, audio guides, digital content, accounts, purchases, location-based features, reviews, and related services operated by TourWhisper, LLC.
By using TourWhisper, creating an account, purchasing an experience, accessing audio content, submitting a review, or using any part of our service, you agree to these Terms. If you do not agree, please do not use TourWhisper.
These Terms should be read together with our Privacy Policy and Cookie Policy, when available. Refund information is included in these Terms and in the Help Center.
1. What TourWhisper Provides
TourWhisper provides digital self-guided audio experiences designed to help visitors explore meaningful places at their own pace. Our experiences may include audio narration, route suggestions, stop-by-stop guidance, maps, images, transcripts, language options, experience styles, accessibility-supportive features, recommendations, and related digital content.
TourWhisper is a digital experience provider. We do not provide an in-person guide, transportation, physical supervision, emergency assistance, venue admission, or guaranteed access to any attraction, museum, landmark, road, park, business, event, or location unless clearly stated.
2. Self-Guided Experience
TourWhisper experiences are self-guided. You are responsible for deciding whether, when, and how to follow any suggested route, stop, narration, direction, recommendation, or map reference.
You are responsible for your own safety and for the safety of any minors, family members, guests, or other people participating with you. Always follow local laws, traffic rules, venue rules, posted signs, road conditions, weather alerts, accessibility notices, public safety instructions, and your own judgment.
Do not use TourWhisper in a way that distracts you from your surroundings.
3. Venue Tickets, Admission, and Third-Party Services Are Not Included
Unless clearly stated on the relevant experience page or at checkout, a TourWhisper purchase does not include admission tickets, parking, transportation, reservations, special exhibit access, food, shows, venue tours, event entry, hotel services, rental equipment, or any service provided by a museum, landmark, park, attraction, city, business, transportation provider, or third party.
You are responsible for confirming opening hours, admission requirements, ticket availability, closures, accessibility, parking, reservations, age restrictions, venue rules, and any other venue or travel requirements before and during your visit.
4. Independent Experiences and Venue Relationships
TourWhisper may create experiences about museums, landmarks, neighborhoods, cities, roads, cultural places, historic sites, scenic areas, and other meaningful locations.
Unless clearly stated, TourWhisper is independent and is not affiliated with, sponsored by, endorsed by, approved by, or officially connected to the venues, institutions, cities, landmarks, museums, parks, businesses, or attractions featured in our experiences.
A guide is only “official,” “partnered,” “approved,” “endorsed,” or “created in collaboration with” a venue, institution, creator, or partner if TourWhisper clearly states that relationship on the relevant experience page or related purchase page.
Some future experiences may be created in collaboration with venues, institutions, creators, or partners. Any official relationship will be disclosed where applicable.
5. Accounts
To purchase, access, save, or use certain TourWhisper experiences, you may need to create an account. You agree to provide accurate information and to keep your login information secure.
You are responsible for all activity under your account. You may not share, sell, transfer, resell, license, or commercially distribute your account access or any TourWhisper experience.
We may suspend, limit, or terminate an account if we believe it has been used in violation of these Terms, used fraudulently, used to copy or redistribute TourWhisper content, used in a way that may harm TourWhisper, or used in a way that may harm other users, partners, venues, creators, service providers, or third parties.
6. Account Deletion
You may request to delete your account through the available account settings or support channel.
If you delete your account, you may lose access to purchased experiences, saved guides, preferences, reviews, account history, and other account-based features. TourWhisper may retain certain information where required or permitted for legal, tax, security, fraud prevention, accounting, dispute resolution, compliance, or legitimate business record purposes.
Deleting your account does not automatically entitle you to a refund.
7. Purchases and One-Year Access
TourWhisper currently offers one-time purchases for individual digital experiences. Unless otherwise stated at checkout, a one-time purchase gives you access to the purchased digital experience for one year from the date of purchase, subject to these Terms.
Access is provided as a limited personal license, not a sale of ownership. You do not own the audio, script, route structure, content, images, design, or other TourWhisper materials.
TourWhisper may update, modify, remove, replace, suspend, or discontinue experiences, features, content, languages, routes, stops, media, or access methods at any time.
8. Future Subscription Options
TourWhisper may introduce subscriptions, memberships, bundles, passes, or other recurring access options in the future. If subscriptions are introduced, the subscription price, renewal terms, billing frequency, cancellation rights, automatic renewal terms, and any applicable trial terms will be disclosed before purchase.
Subscription terms will apply only if you choose to purchase a subscription or recurring product.
9. Checkout Disclosures
TourWhisper may present key purchase terms before checkout, including price, access period, refund window, what is included, what is not included, whether admission tickets are included, whether the experience is independent or official, and any important limitations.
You are responsible for reviewing the information shown on the experience page and at checkout before completing a purchase.
If there is a conflict between a specific purchase disclosure shown at checkout and these general Terms, the checkout disclosure will apply to that purchase only, unless prohibited by law.
10. Prices, Taxes, Currency, and Payment Providers
Prices may be shown in U.S. dollars or another available currency. TourWhisper may change prices at any time before purchase.
Taxes, VAT, sales tax, foreign transaction fees, card fees, exchange-rate differences, bank charges, platform fees, payment-provider fees, or similar charges may apply and are your responsibility unless clearly stated otherwise.
Payments may be processed by third-party payment providers, app stores, platforms, or financial service providers. TourWhisper is not responsible for delays, errors, declines, fees, currency conversions, chargebacks, or processing issues caused by third-party payment systems.
11. Service Availability and Business Closure
TourWhisper is provided as an online digital service. We work to keep the service available, but we do not guarantee that TourWhisper will always be available, uninterrupted, error-free, secure, or compatible with every device, browser, network, operating system, country, or location.
If TourWhisper, LLC discontinues the website, app, service, business, or a specific experience, access may end before the original access period. To the fullest extent permitted by law, TourWhisper will not be required to continue hosting, maintaining, supporting, replacing, or providing discontinued services, features, or content.
Nothing in this section limits rights that cannot be waived under applicable law.
12. Streaming and Offline Access
At launch, TourWhisper experiences may be available through streaming audio or web-based access. Offline access may be added in the future but is not guaranteed unless clearly stated.
You are responsible for your own device, battery, internet connection, data charges, headphones, speakers, browser settings, app settings, operating system, and any other technology needed to access TourWhisper.
TourWhisper is not responsible if you cannot access an experience because of poor signal, lack of internet connection, low battery, device incompatibility, browser limitations, app-store issues, account issues, location restrictions, or third-party technical problems.
13. Refund Policy
For the initial launch period, you may request a refund within one hour after purchase for any reason.
TourWhisper may ask you to provide a reason for the refund request so we can improve the experience. An eligible refund request submitted within the one-hour window will not be denied solely because of the reason provided.
To request a refund, you must submit the request through the designated TourWhisper support or refund channel and provide the requested purchase information.
Approved refunds may take up to 30 days to process, depending on the payment provider, banking system, card issuer, app store, platform, or other processing partner.
After the one-hour refund window, purchases are generally non-refundable, except where required by law or where TourWhisper determines, in its discretion, that a technical issue prevented reasonable access to the purchased experience.
TourWhisper may deny refund requests that appear abusive, fraudulent, repeated, automated, inconsistent with these Terms, or connected to misuse of the service.
Nothing in this Refund Policy limits rights that cannot be waived under applicable law.
14. Location, GPS, and Route Features
TourWhisper may use or request location information, GPS signals, device permissions, map data, browser permissions, or similar technologies to support route guidance, nearby stops, location-based playback, recommendations, safety reminders, personalization, or experience functionality.
Location-based features may require your permission. You may disable location access through your device, browser, or app settings, but some TourWhisper features may not work properly without it.
GPS, maps, routes, estimated distances, walking paths, driving routes, stop locations, and location-based features may be approximate, delayed, incomplete, unavailable, or inaccurate. TourWhisper does not guarantee that any suggested route, stop, direction, or location is safe, open, accessible, legal, available, or suitable for your circumstances.
You are responsible for checking your surroundings and using your own judgment at all times.
15. Driving and Road Safety
Some TourWhisper experiences may be designed for scenic drives, road trips, or vehicle-based exploration.
Drivers must not hold, read, adjust, browse, or interact with TourWhisper while driving. The driver is responsible for safe operation of the vehicle at all times. Use audio controls, route settings, mobile devices, maps, or other features only when it is safe and legal to do so.
TourWhisper is not responsible for traffic conditions, road closures, accidents, fines, parking issues, navigation errors, unsafe driving, distracted driving, weather conditions, vehicle issues, transportation issues, or any loss or injury related to driving or travel.
16. Walking, Public Spaces, and Physical Conditions
Some experiences may involve walking, standing, stairs, sidewalks, streets, crossings, crowds, uneven surfaces, remote areas, weather exposure, or public spaces.
You are responsible for deciding whether a route or stop is appropriate for your health, mobility, comfort, group, and circumstances.
TourWhisper does not control sidewalks, streets, lighting, weather, crowds, venue layouts, traffic, construction, accessibility, public safety, road conditions, or local conditions.
17. Minors and Family Use
TourWhisper may include content or experience styles designed to be family-friendly or helpful for younger visitors. However, TourWhisper is not intended for children to use without supervision.
Parents and guardians are responsible for supervising minors and determining whether any experience, route, story, location, or content is appropriate for them.
If a minor uses TourWhisper through your account, you are responsible for that use.
18. Accessibility and Inclusive Features
TourWhisper may offer features such as transcripts, descriptive narration, adjustable pacing, flexible routes, clearer guidance, or other accessibility-supportive elements.
These features are intended to support a wider range of visitors, but TourWhisper does not guarantee that every experience, route, stop, venue, sidewalk, road, exhibit, viewpoint, or location will be accessible to every visitor.
TourWhisper does not control venue accessibility, elevators, ramps, sidewalks, seating, lighting, sound levels, crowds, exhibit placement, road conditions, restroom access, or other physical conditions.
19. Content Accuracy
TourWhisper works to create experiences that are thoughtfully researched and grounded in trusted sources. However, historical, cultural, scientific, geographic, venue, and local information may change, evolve, become outdated, or contain errors.
TourWhisper content is provided for educational, cultural, entertainment, and informational purposes only. It should not be relied on as legal, safety, medical, professional, emergency, transportation, or official venue advice.
If you notice an issue, you may contact TourWhisper or use available feedback tools to help us improve the experience.
20. User Reviews, Ratings, Feedback, and Submissions
You may be able to submit reviews, ratings, comments, corrections, photos, suggestions, or other feedback. By submitting content to TourWhisper, you confirm that your submission is truthful, based on your own experience, and does not violate the rights of another person or organization.
You may not submit false, misleading, illegal, abusive, defamatory, hateful, infringing, promotional, spam, paid, manipulated, or fraudulent content.
TourWhisper may remove, reject, edit, or refuse submissions at its discretion, including submissions that violate these Terms, appear unreliable, contain inappropriate content, or are unrelated to the experience.
By submitting content to TourWhisper, you grant TourWhisper, LLC a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, edit, publish, display, distribute, and incorporate your submission for operating, improving, promoting, and developing TourWhisper.
21. Intellectual Property
TourWhisper, the TourWhisper name, logo, brand, audio, scripts, narration, route structure, experience design, text, images, visual design, interface, features, software, and other original materials are owned by TourWhisper, LLC or its licensors and are protected by intellectual property laws.
You may not copy, record, download, scrape, reproduce, redistribute, sell, modify, publish, train artificial intelligence systems on, or create derivative works from TourWhisper content unless we give written permission.
22. Personal, Non-Commercial License
When you purchase or access a TourWhisper experience, TourWhisper grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that experience for your own personal, non-commercial use during the applicable access period.
You do not own the content. You may not use TourWhisper content for commercial tours, public performances, resale, training, competing products, travel packages, venue services, group tours, institutional programs, classroom distribution, or any business purpose without written permission.
23. Third-Party Services and Links
TourWhisper may link to or rely on third-party services, including payment processors, app stores, map providers, analytics providers, ticketing platforms, venue websites, transportation services, creator content, social media platforms, cloud hosting providers, and external sources.
TourWhisper is not responsible for third-party content, policies, pricing, accuracy, availability, actions, services, fees, or technical issues.
Your use of third-party services may be governed by their own terms and privacy policies.
24. Privacy
Your use of TourWhisper is also governed by our Privacy Policy and Cookie Policy. These policies explain how we collect, use, store, and share information, including account information, purchase information, device information, analytics information, cookies, preferences, and location-related information where applicable.
By using TourWhisper, you agree that we may process information as described in those policies.
25. International Users
TourWhisper, LLC is based in the United States. You may access or purchase TourWhisper from outside the United States, but you are responsible for complying with the laws and rules that apply to you in your location.
TourWhisper does not guarantee that the service, content, purchases, refunds, features, or access methods are appropriate or available in every country.
If you access TourWhisper from outside the United States, some local consumer protection laws may apply and may provide rights that cannot be waived by these Terms. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
TourWhisper may limit or block access in certain countries, regions, or situations where required by law, sanctions, export controls, payment restrictions, platform restrictions, business decision, technical limitations, or risk management policies.
26. Prohibited Uses
You agree not to:
- Copy, record, resell, redistribute, or commercially exploit TourWhisper content.
- Share your account or purchased access outside your personal use.
- Use TourWhisper while driving in an unsafe or illegal way.
- Use TourWhisper to violate laws, venue rules, traffic rules, platform rules, or third-party rights.
- Scrape, extract, crawl, reverse engineer, or interfere with the service.
- Submit false, misleading, abusive, infringing, paid, manipulated, or fraudulent content.
- Use TourWhisper content to build, train, or improve a competing product or service.
- Misrepresent an affiliation with TourWhisper, a venue, an institution, creator, or third party.
- Attempt to bypass payment, access controls, security tools, account limits, or usage limitations.
- Use TourWhisper in a way that harms or disrupts the service, users, venues, creators, partners, or third parties.
27. Changes to Experiences and Terms
TourWhisper may update, modify, remove, suspend, replace, or discontinue any part of the service, including experiences, routes, stops, audio, languages, prices, features, availability, and access methods.
We may also update these Terms from time to time. The updated Terms will be posted with a new “Last updated” date. Continued use of TourWhisper after changes means you accept the updated Terms.
We will not use changes to these Terms to take away rights already required by applicable law.
28. Disclaimer of Warranties
TourWhisper is provided “as is” and “as available.” To the fullest extent permitted by law, TourWhisper, LLC disclaims all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, safety, accessibility, and uninterrupted service.
We do not guarantee that TourWhisper will meet your expectations, be available at all times, work in every location, remain available for the full access period, or be free of errors.
29. Limitation of Liability
To the fullest extent permitted by law, TourWhisper, LLC and its owners, employees, contractors, partners, creators, licensors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost access, travel costs, missed reservations, missed experiences, venue closures, injuries, accidents, delays, device issues, data charges, or third-party actions.
TourWhisper is not responsible for injuries, accidents, losses, damages, fines, claims, or expenses arising from your travel, walking, driving, navigation, venue visits, public-space activity, weather exposure, traffic, road conditions, personal decisions, device use, or failure to follow laws, posted signs, venue rules, or safety precautions.
To the fullest extent permitted by law, TourWhisper’s total liability for any claim related to a purchased experience will not exceed the amount you paid for that specific experience.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
30. Indemnification
You agree to defend, indemnify, and hold harmless TourWhisper, LLC and its owners, employees, contractors, partners, creators, licensors, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from your use of TourWhisper, your violation of these Terms, your violation of law, your unsafe behavior, your submissions, or your violation of another person’s rights.
31. Governing Law
These Terms are governed by the laws of the State of California and the laws of the United States, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.
