Terms of Use

These Terms govern access to and use of the TourWhisper website, digital audio guides, accounts, purchases, location-based features, reviews, and related services operated by TourWhisper, LLC.

By using TourWhisper, creating an account, purchasing an experience, accessing audio content, submitting a review, or using any part of the service, you agree to these Terms. If you do not agree, please do not use TourWhisper.

These Terms should be read together with the Privacy Policy. Practical support and refund information is also available in the Help Center.

1. What TourWhisper Provides

TourWhisper provides digital self-guided audio experiences designed to help visitors explore meaningful places at their own pace. Experiences may include audio narration, route suggestions, stop-by-stop guidance, maps, images, transcripts, language options, experience styles, accessibility-supportive features, recommendations, and related digital content.

TourWhisper is a digital experience provider. Unless clearly stated, we do not provide an in-person guide, transportation, physical supervision, emergency assistance, venue admission, or guaranteed access to any attraction, museum, landmark, road, park, business, event, or location.

2. Self-Guided Experience and Safety

TourWhisper experiences are self-guided. You decide whether, when, and how to follow any suggested route, stop, narration, direction, recommendation, or map reference.

You are responsible for your own safety and for the safety of minors, family members, guests, or other people participating with you. Follow applicable laws, traffic rules, venue rules, posted signs, road conditions, weather alerts, accessibility notices, public-safety instructions, and your own judgment.

Do not use TourWhisper in a way that distracts you from your surroundings. Drivers must not hold, read, browse, or adjust TourWhisper while driving.

3. Venue Tickets and Third-Party Services Are Not Included

Unless clearly stated on the relevant experience page or at checkout, a TourWhisper purchase does not include admission tickets, parking, transportation, reservations, special exhibit access, food, shows, venue tours, event entry, hotel services, rental equipment, or services provided by a museum, landmark, park, attraction, city, business, transportation provider, or other third party.

You are responsible for confirming opening hours, admission requirements, ticket availability, closures, accessibility, parking, reservations, age restrictions, venue rules, and other visit requirements.

4. Independent Experiences and Venue Relationships

Unless clearly stated, TourWhisper is independent and is not affiliated with, sponsored by, endorsed by, approved by, or officially connected to the places featured in our experiences.

A guide is described as official, partnered, endorsed, or created in collaboration with a venue or partner only when TourWhisper clearly discloses that relationship.

5. Accounts and Secure Sign-In

Certain features may require an account or secure email sign-in. You agree to provide accurate information, use the same email address associated with your purchase when accessing a guide, and keep account credentials and secure sign-in links confidential.

You are responsible for activity under your account. We may suspend, limit, or terminate access when we reasonably believe an account has been used fraudulently, shared improperly, used to copy or redistribute content, or otherwise used in violation of these Terms.

6. Personal Access, Listening Together, and Device Use

Each purchase grants the purchaser a limited, personal, non-exclusive, non-transferable, revocable license to access the selected guide during the applicable access period.

You may play the guide aloud for companions who are physically exploring with you, including through a phone speaker, shared audio equipment, headphones, or vehicle speakers.

You may not share your account, login credentials, secure sign-in link, or purchased access so another person can use the guide independently.

The purchaser may currently access the guide on up to two personal devices, including at the same time. This allowance does not permit account sharing or separate independent use by another person.

TourWhisper may use reasonable technical measures to prevent unauthorized sharing, excessive device use, fraud, scraping, redistribution, or misuse. Any materially different device limit applicable to a future purchase will be disclosed before that purchase is completed.

7. One-Time Purchases, Digital Delivery, and One-Year Access

TourWhisper currently offers one-time purchases for individual digital experiences. No physical product is shipped.

After successful payment, the confirmation screen will indicate that the guide is available, and the purchaser will receive an email confirming the payment. Access is connected to the email address used for the purchase.

Unless a different period is clearly displayed before purchase, access lasts for one year from the purchase date, subject to these Terms.

If access does not appear, close the browser and sign in again using the same purchase email. TourWhisper may send a secure sign-in link to that email address.

8. No Current Subscriptions or Recurring Charges

TourWhisper currently offers one-time guide purchases only. There are no current subscriptions, automatic renewals, or recurring charges to cancel.

TourWhisper may introduce subscriptions, memberships, bundles, passes, or recurring products in the future. Any price, billing frequency, renewal term, cancellation right, and trial condition will be disclosed before purchase.

9. Prices, Promotions, Currency, Taxes, and Payments

Prices vary by guide and may change before purchase. TourWhisper’s base prices are set in U.S. dollars.

Depending on the customer’s location and available checkout options, prices may be displayed and processed in another supported currency. The final price and payment currency will be shown before purchase.

TourWhisper may offer promotional prices or discounts for a limited time. A promotion remains available only while it is displayed on the applicable guide page or at checkout. The final discount and price will be shown before payment.

Any applicable taxes will be calculated and shown before payment is completed. A bank, card issuer, or payment provider may separately impose foreign-transaction or currency-conversion charges that TourWhisper does not control.

Payments are processed by Stripe or another disclosed payment provider. TourWhisper does not store complete payment-card details on its own systems.

10. Refund Policy

You may request a full refund within one hour after payment is successfully completed, for any reason.

To request a refund, email support@tourwhisper.com within the one-hour period. Send the request from the same email address used for the purchase and include the guide name, purchase date, and order or receipt information, if available.

The time the email is sent determines whether the request was submitted within the one-hour period. An eligible request remains eligible even if you have already opened, accessed, or listened to part or all of the guide.

After one hour, purchases are generally non-refundable, except where required by law or when a verified TourWhisper technical issue prevented reasonable access to the purchased guide.

Approved refunds are returned to the original payment method and normally appear within five to ten business days, depending on the customer’s bank or payment method.

TourWhisper may deny refund requests that appear fraudulent, abusive, automated, repeated in bad faith, or connected to misuse of the service. Nothing in this Refund Policy limits rights that cannot be waived under applicable law.

11. Shipping, Physical Returns, and Cancellations

TourWhisper sells digital audio experiences. No physical products are shipped, and there are no physical products to return.

Because TourWhisper currently offers one-time purchases and no subscriptions or reservations, there is no recurring plan or booking to cancel. Requests involving guide purchases are handled under the Refund Policy.

12. Service Availability and Technical Requirements

TourWhisper is provided as an online digital service. We work to keep the service available but do not guarantee uninterrupted, error-free, or universal compatibility with every device, browser, network, operating system, country, or location.

You are responsible for your device, battery, internet connection, data charges, headphones or speakers, browser settings, and other technology needed to access the service.

At launch, experiences may be available through streaming or web-based access. Offline access is not guaranteed unless clearly stated.

13. Location, GPS, Maps, and Routes

TourWhisper may use or request location information, GPS signals, device permissions, map data, or similar technologies to support route guidance, nearby stops, location-based playback, recommendations, and experience functionality.

GPS, maps, routes, estimated distances, walking paths, driving routes, stop locations, and location-based features may be approximate, delayed, incomplete, unavailable, or inaccurate. You remain responsible for checking your surroundings and using your own judgment.

14. Driving, Walking, and Physical Conditions

Drivers must not hold, read, browse, or adjust TourWhisper while driving. Set up audio and route controls only when safe and legal, and allow a passenger to operate the device when possible.

Some experiences may involve walking, standing, stairs, sidewalks, streets, crossings, crowds, uneven surfaces, remote areas, or weather exposure. You are responsible for deciding whether a route or stop is suitable for your health, mobility, comfort, group, and circumstances.

15. Minors and Family Use

TourWhisper may include family-friendly content, but the service is not intended for children to use without appropriate supervision. Parents and guardians are responsible for supervising minors and deciding whether an experience is appropriate.

16. Accessibility

TourWhisper may offer transcripts, descriptive narration, adjustable pacing, flexible routes, clearer guidance, or other accessibility-supportive elements. We do not guarantee that every guide, stop, venue, sidewalk, road, exhibit, or physical location will be accessible to every visitor.

17. Content Accuracy

TourWhisper works to create thoughtfully researched experiences grounded in trusted sources. Historical, cultural, scientific, geographic, venue, and local information can change, evolve, become outdated, or contain errors.

Content is provided for educational, cultural, entertainment, and informational purposes and should not be relied on as legal, safety, medical, professional, emergency, transportation, or official venue advice.

18. Reviews, Ratings, Feedback, and Submissions

If you submit reviews, ratings, comments, corrections, photos, suggestions, or other feedback, you confirm that the submission is truthful, based on your own experience, and does not violate another person’s rights.

By submitting content, you grant TourWhisper, LLC a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, edit, publish, display, distribute, and incorporate the submission for operating, improving, promoting, and developing TourWhisper.

19. Intellectual Property and Prohibited Copying

TourWhisper, its name, logo, audio, scripts, narration, route structures, experience design, text, images, interface, software, and original materials are owned by TourWhisper, LLC or its licensors and are protected by intellectual-property laws.

You may not copy, record, download, scrape, reproduce, redistribute, sell, publish, train artificial-intelligence systems on, or create derivative works from TourWhisper content without written permission.

20. Third-Party Services and Links

TourWhisper may link to or rely on third-party services, including payment processors, map providers, analytics providers, venue websites, transportation services, social platforms, hosting providers, and external sources.

Third-party services are governed by their own terms and privacy policies. TourWhisper is not responsible for third-party content, pricing, accuracy, availability, actions, fees, or technical issues.

21. Privacy

Your use of TourWhisper is governed by our Privacy Policy, which explains how we collect, use, store, and share information, including account, purchase, device, usage, cookie, preference, and location-related information where applicable.

22. International Users

TourWhisper, LLC is based in the United States. Users outside the United States are responsible for complying with laws applicable in their location. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

23. Prohibited Uses

You may not copy, record, resell, redistribute, or commercially exploit TourWhisper content; share account access for independent use; bypass payment or access controls; scrape or reverse engineer the service; use the service unlawfully or unsafely; submit fraudulent or infringing content; or interfere with the service or other users.

24. Changes to Experiences and Terms

TourWhisper may update, modify, remove, suspend, replace, or discontinue experiences, routes, stops, audio, languages, prices, features, availability, and access methods.

We may update these Terms by posting a revised version with a new Last Updated date. We will not use changes to take away rights that cannot be waived under applicable law.

25. Disclaimer of Warranties

TourWhisper is provided “as is” and “as available.” To the fullest extent permitted by law, TourWhisper, LLC disclaims warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, safety, accessibility, and uninterrupted service.

26. Limitation of Liability

To the fullest extent permitted by law, TourWhisper, LLC and its owners, employees, contractors, partners, creators, licensors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the service.

To the fullest extent permitted by law, TourWhisper’s total liability for a claim related to a purchased guide will not exceed the amount paid for that guide. Some jurisdictions do not allow certain limitations, so some limits may not apply.

27. Indemnification

You agree to defend, indemnify, and hold harmless TourWhisper, LLC and its owners, employees, contractors, partners, creators, licensors, and service providers from claims arising from your use of TourWhisper, violation of these Terms, violation of law, unsafe behavior, submissions, or violation of another person’s rights, to the extent permitted by law.

28. Governing Law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
