1. Our Privacy Promise

TourWhisper does not sell your personal information, rent or trade it, or provide it to data brokers.

We do not currently share personal information for cross-context behavioral advertising, and we do not use precise location information to track users across unrelated apps, websites, or services.

2. Information You Provide

We may collect information you choose to provide, including your name, email address, account and login information, purchase-related information, support and refund requests, newsletter signups, reviews, ratings, corrections, language preferences, experience preferences, route selections, accessibility-related preferences, and other information submitted through forms, account settings, checkout, support, or communications.

3. Account and Access Information

We may collect and store information related to your account and guide access, including your email address, secure sign-in activity, purchase history, saved experiences, preferences, device-access information, reviews, account settings, and support history.

We may use this information to confirm purchases, provide access to purchased guides, send secure sign-in links, prevent unauthorized account sharing, and protect the service from fraud or misuse.

4. Purchase and Payment Information

We may collect purchase-related information, including the guide purchased, purchase date, access period, price, currency, applicable tax, discount, refund status, transaction identifiers, and related checkout information.

Payments are processed by Stripe or another disclosed payment provider. TourWhisper does not store complete payment-card details on its own systems. Payment providers process payment information according to their own terms and privacy policies.

We may send purchase confirmations, receipts, access notices, refund updates, and other service-related communications to the email address associated with the transaction.

5. Location, GPS, and Route Information

TourWhisper may use or request precise or approximate location information, GPS signals, device permissions, browser permissions, map data, or similar technologies to support route guidance, nearby stops, location-based playback, recommendations, safety reminders, personalization, and experience functionality.

You can usually disable location access in your device or browser settings, but some features may not work properly without it.

6. Device, Usage, and Technical Information

When you use TourWhisper, we may automatically collect information such as IP address, device type, browser, operating system, referring pages, pages or screens viewed, search activity, audio playback activity, guide-access activity, approximate location derived from IP address, error logs, performance data, and cookie or similar-technology identifiers.

We may use this information to operate, secure, troubleshoot, improve, personalize, and analyze TourWhisper.

7. Cookies and Similar Technologies

TourWhisper may use cookies, local storage, pixels, analytics tools, and similar technologies to operate the website, maintain sessions and secure sign-in, remember preferences, understand usage, improve performance, measure marketing effectiveness, prevent fraud, and support security.

Some technologies may be necessary for the service to function. Others may be used for analytics, personalization, or marketing where permitted.

TourWhisper does not currently intend to use cookies or similar technologies to sell personal information or share personal information for cross-context behavioral advertising. If our practices materially change, we will update this Privacy Policy and provide any notice or choices required by law.

8. How We Use Information

We may use information to provide and operate the service; create and manage accounts; process purchases, taxes, and refunds; provide guide access; deliver audio, route features, and transcripts; personalize experiences; provide support; send service-related and permitted marketing communications; improve content and accessibility; analyze performance; prevent fraud, scraping, unauthorized sharing, and abuse; protect rights and safety; comply with legal, tax, accounting, regulatory, and contractual obligations; and enforce our Terms.

9. How We Share Information

TourWhisper does not sell personal information or provide it to data brokers.

We may share information as needed with payment processors, app stores or checkout platforms, hosting and cloud providers, analytics providers, map or location providers, email providers, customer-support tools, security and fraud-prevention providers, professional advisors, government authorities where required or permitted, and parties involved in a merger, acquisition, financing, reorganization, or business transfer.

We may share aggregated, de-identified, or non-personal information that does not reasonably identify you.

10. Partners, Venues, Institutions, and Creators

Some experiences may be created with venues, institutions, creators, or partners. Unless clearly disclosed, we do not share directly identifiable user information with those parties for their own independent marketing without appropriate notice or consent.

We may share aggregated or non-identifying information such as general usage trends, guide performance, or feedback themes.

11. Marketing Communications

If you sign up for updates, newsletters, launch announcements, offers, or marketing communications, we may use your email address to send those messages. You may unsubscribe using the link in an email or by contacting us.

Even after unsubscribing from marketing, we may send service-related messages such as purchase confirmations, secure sign-in links, account notices, refund updates, security alerts, policy updates, and support responses.

12. Reviews, Feedback, and Public Submissions

If TourWhisper offers reviews, ratings, comments, corrections, photos, suggestions, or other feedback, we may collect and use that information to operate, improve, moderate, promote, and develop the service.

Some submissions may be visible to other users. Do not submit personal information that you do not want others to see.

13. Artificial Intelligence and Content Improvement

TourWhisper may use technology, including artificial-intelligence tools, to help create, improve, translate, organize, test, or support audio experiences, website content, support workflows, and product features.

If user feedback, support messages, reviews, corrections, or usage information is used to improve TourWhisper, it will be handled consistently with this Privacy Policy.

14. Children and Minors

TourWhisper is not intended for children under 13 to use without a parent or guardian. We do not knowingly collect personal information directly from children under 13. If we learn that we have done so without appropriate authorization, we will take reasonable steps to delete it.

15. International Users and Legal Bases

TourWhisper, LLC is based in the United States. Information may be processed or stored in the United States or other countries where our service providers operate.

Where required, we may rely on performance of a contract, compliance with legal obligations, legitimate interests in operating and securing the service, protection of rights and safety, or consent.

16. Your Choices and Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, obtain a copy of, object to, restrict, or withdraw consent for certain processing, and to opt out of marketing communications.

You may disable location access and cookies or similar technologies through applicable browser, device, or app settings. We may need to verify your identity before completing certain requests.

17. California Privacy Rights

If applicable California privacy laws cover TourWhisper or your information, California residents may have additional rights to know, access, correct, delete, and opt out of certain uses or disclosures.

TourWhisper does not sell personal information and does not currently share personal information for cross-context behavioral advertising. We will not discriminate against users for exercising rights required by law.

18. Data Retention

We keep personal information for as long as reasonably necessary to provide the service, maintain accounts and guide access, process purchases and refunds, provide support, improve experiences, comply with legal and tax obligations, resolve disputes, prevent fraud, enforce agreements, and maintain business records.

We may retain certain information after account deletion where required or permitted for legal, tax, accounting, security, fraud-prevention, dispute-resolution, compliance, or legitimate business-record purposes.

19. Security

TourWhisper uses reasonable administrative, technical, and organizational measures designed to protect personal information. No website, network, database, payment system, transmission method, or storage system can be guaranteed to be completely secure.

You are responsible for keeping account credentials and secure sign-in links confidential and for using safe devices, networks, and browsers.

20. Third-Party Services and Links

TourWhisper may link to or rely on payment processors, map providers, analytics providers, ticketing platforms, venue websites, transportation services, social-media platforms, cloud providers, and external sources. Those services collect and use information according to their own privacy policies and terms.

21. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted with a new Last Updated date. If changes are material, we may provide additional notice where required by law or appropriate.
